E-Sign Notice
Electronic Consent Agreement
This Agreement covers receiving notices and documents electronically. "We/us/our" refers to:
- Cross River Bank (card issuer)
- Highnote Platform Inc. (servicer)
- Their affiliates, successors, agents, or service providers
"You/your" means each account holder, product owner, service user, or authorized representative.
Purpose
Under the ESIGN Act and related state laws, with consent, Communications may be provided electronically with the same legal effect as paper. Services are delivered via internet, requiring electronic consent. Refusing consent means Spring cannot process your application.
Scope of This Agreement
Applies to all accounts, products, and services — present and future. Covered Communications include:
- This Agreement and updates
- Agreements, contracts, disclosures, legally required notices, and updates
- All website/electronic communications
- Tax statements and IRS interest notices
- Forms requested electronically
Your Consent
By agreeing, you represent that you:
- Have read and understand this Agreement
- Have equipment capable of accessing, printing, or saving documents
- Consent remains in effect until withdrawn
Methods of Electronic Delivery
Communications may be delivered:
- By email to your designated address
- Via your account dashboard at a designated website or app
- Per any other agreement with you
Security procedures may apply. Oral communication does not qualify as an electronic record. Account closure may result in loss of access to prior Communications.
Spring may, at its discretion, still provide paper copies (e.g., during system outages or suspected fraud).
Access to Paper Copies
Use your browser or PDF application's print/save function. Copies are retained as required by law. Save or print Communications for your own records.
Hardware and Software Requirements
To access electronic Communications, you need:
- Working internet access
- Browser supporting 128-bit encryption (latest Chrome, Firefox, Edge, or Safari)
- Sufficient storage: 16 MB available memory or 32 MB RAM recommended
- A current PDF reader (e.g., Adobe Reader 7.0+)
- A compatible operating system
- A valid email address
If requirements change materially, you will be notified. Continued use constitutes acceptance.
Withdrawing Consent
You may withdraw at any time, at no charge. Withdrawal becomes effective after a reasonable processing period. Prior Communications remain legally valid. Account closure may result from withdrawal.
Updating Your Contact Information
Keep your email address current. Notify Spring of changes via account settings or at:
Spring is not responsible for delays if an outdated email address is on file. Communications sent to your last provided address are still considered delivered.
Termination or Changes
Spring reserves the right to discontinue, terminate, or modify this Agreement, with notice as required by law.
